People used to think that prenuptial agreements were just for celebrities or the super-wealthy. That’s no longer the case. The American Academy of Matrimonial Lawyers released results from a survey showing a large increase in prenups. And just as importantly, it is that the interest in prenups is increasingly being initiated by women.
Robust financial and real estate markets have increased the interest in sharing these gains in a divorce. The common trend during the “great recession” of spouses fighting over who would take possession of an under-water home and other depreciated assets is over.
The three items most commonly covered in prenups are the protection of separate property, spousal support and the division of property.
